  1. End User shall acquire no proprietary rights in or to the Participant Licensed Content provided by mainehomes.com, which rights remain in Down East Enterprise and its data suppliers.
  2. The data herein is sourced from public, publicly available or non-public sources and is provided on an “as is, as available” basis, and the data supplier does not make any warranties (express or implied) including, without limitation, those of merchantability and fitness for a particular purpose, nor is the Down East Enterprise data supplier responsible for errors or omissions.
  3. End User acknowledges that the content herein is proprietary information of Down East Enterprise and its suppliers, is protected by copyright and others laws governing intellectual property rights, and has been furnished to End User in trust. End User acknowledges that the information is a valuable commercial product, the development of which has involved the expenditure of substantial time and money. End User shall initiate strict security measures to prevent the accidental or otherwise unauthorized use or release of the content, with particular respect to consumer information that is considered “sensitive,” namely: financial information, including but not limited to, listing price, sales price, mortgage values, and real estate loan information as related to a named individual owner.
  4. End User assumes sole responsibility for all use of mainehomes.com, including the liability and responsibility for any and all claims, demands, losses, damages, liabilities, costs, charges and expenses, including reasonable attorney’s fees, arising out of the use of mainehomes.com, and indemnifies Down East Enterprise and its suppliers or licensors with respect thereto. Any use of mainehomes.com by End User pursuant to this Agreement shall be at its own risk, and Down East Enterprise and its suppliers or licensors shall not be responsible for any errors or omissions.
  5. End User shall comply with all applicable privacy, data security, best practices and all other laws, rules and regulations, including but not limited to, the Gramm Leach Bliley Act, the Fair and Accurate Credit Transactions Act, Federal Do-Not-Call laws, any other state Do-Not-Call laws, and the CAN-SPAM Act.
